Terms of Service

1. Acceptance of Terms

By accessing or using Clozup ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Clozup is an AI-powered outbound sales automation platform. The Service includes lead management, email sequences, deal pipeline, voice calls, AI assistant, analytics, and related features as described on our website and documentation.

3. Accounts

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old to use the Service
  • One person or entity may not maintain more than one free account

4. Acceptable Use

You agree not to:

  • Send unsolicited bulk emails (spam) through the platform
  • Violate any applicable anti-spam laws (CAN-SPAM, GDPR, etc.)
  • Use the AI assistant to generate harmful, misleading, or illegal content
  • Attempt to access other users' data or accounts
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the Service for any illegal purpose

5. Plans & Billing

  • Paid plans are billed monthly or annually as selected at purchase
  • Prices are in EUR and exclude applicable taxes
  • Upgrades take effect immediately with prorated billing
  • Downgrades take effect at the end of the current billing period
  • Credits do not roll over between billing periods

6. Cancellation & Refunds

  • You may cancel your subscription at any time from Settings
  • Cancellation takes effect at the end of the current billing period
  • Data is retained for 30 days after cancellation, then permanently deleted
  • Refunds are available within 14 days of initial purchase if unsatisfied
  • No refunds for partial months or unused credits

7. Your Data

You retain all ownership rights to your data. Clozup does not claim any ownership over your leads, deals, campaigns, or any other content you create. You grant us a limited license to process your data solely to provide the Service.

8. AI Features

  • AI-generated content (emails, insights, suggestions) is provided as-is
  • You are responsible for reviewing and approving AI-generated content before sending
  • AI features consume credits as described in the Credit System
  • Your data is not used to train AI models

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance. Enterprise plans include SLA guarantees.

10. Limitation of Liability

To the maximum extent permitted by law, Clozup shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France.
